1. About These Terms
These Terms & Conditions ("Terms") govern your use of the Buildupnet website located at https://www.buildupnet.com/ and the services offered by Buildupnet ("we", "us", "our").
By accessing this website or engaging our services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use this website or our services.
2. Our Services
Buildupnet offers the following services:
- Website design and development
- Ecommerce website development
- Android and iOS mobile app development
- Search engine optimisation (SEO) and link building
- Content marketing and social media management
- Google Ads and Meta Ads campaign management
- Networking setup and annual maintenance contracts (AMC)
The specific scope, deliverables, timelines and pricing for each engagement are defined in a written project proposal or agreement shared with the client before work commences.
3. Project Agreements and Proposals
All projects begin with a written proposal or statement of work agreed upon by both parties. The proposal outlines the scope, timeline, cost and payment terms. Work begins only after the client approves the proposal and makes any required advance payment.
Any changes to the agreed scope of work requested after project commencement may result in revised timelines and additional charges, which will be communicated to the client before implementation.
4. Payment Terms
- A percentage advance payment (as stated in the project proposal) is required before work begins.
- Milestone payments are due as outlined in the proposal upon completion of each deliverable.
- Final payment is due before the final deliverable (website/app launch or file handover).
- Payments are non-refundable once the corresponding milestone or phase of work has been completed.
- Delayed payments may result in work being paused until outstanding amounts are settled.
5. Client Responsibilities
To ensure timely delivery, the client agrees to:
- Provide all required content (text, images, logos, brand guidelines) within agreed timelines
- Provide timely feedback and approvals at each project milestone
- Ensure that all content and materials supplied do not infringe third-party intellectual property rights
- Provide access to required accounts (hosting, domain, social media, Google) as needed
Buildupnet is not liable for project delays caused by late or incomplete client inputs, approvals or payments.
6. Intellectual Property
Upon receipt of full and final payment, all custom design and code created specifically for the client's project is assigned to the client. This includes website layouts, graphics, written copy (if created by us), and application code.
Buildupnet retains the right to display completed work in its portfolio and marketing materials unless the client requests otherwise in writing prior to project commencement.
Any third-party assets used in the project (stock images, fonts, plugins, frameworks) remain subject to their respective licences and are the client's responsibility to maintain going forward.
7. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of the engagement. Buildupnet will not disclose client data, project details or proprietary business information to any third party without prior written consent, except where required by law.
8. Website Use
By using the Buildupnet website, you agree that you will not:
- Use the website for any unlawful purpose
- Attempt to gain unauthorised access to any part of the site or its infrastructure
- Upload or transmit any malicious code, spam or harmful content via our contact or application forms
- Reproduce, copy or redistribute any content from this website without our written permission
9. Limitation of Liability
Buildupnet provides its services with reasonable skill and care. However, we do not guarantee specific business outcomes (such as search engine rankings, lead volume or revenue) as these depend on many factors outside our control.
To the maximum extent permitted by applicable law, Buildupnet's total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim. We are not liable for indirect, incidental or consequential losses.
10. Third-Party Services
We may recommend or use third-party services (hosting providers, payment gateways, analytics platforms, etc.) as part of project delivery. Buildupnet is not responsible for the terms, uptime, pricing changes or discontinuation of third-party services. The client assumes responsibility for any third-party service accounts set up in their name.
11. Termination
Either party may terminate a project engagement with 14 days' written notice. Upon termination, the client is liable to pay for all work completed up to the termination date. Work completed and paid for will be delivered; unpaid work will be withheld until outstanding payments are cleared.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Sangrur, Punjab, India.
13. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms.
